Terms of Service

These Terms of Service (the "Terms") set out the conditions for using the application "Voikerchat" (the "App") provided by Shibuyer ("we", "us", or "our"). By using the App, you agree to be bound by these Terms.

Article 1 (Application)

These Terms apply to all relations between us and you arising in connection with your use of the App.

Article 2 (Definitions)

• "Service" means the Japanese-language learning features we provide through the App.
• "User" means any person who agrees to these Terms and uses the App.
• "Premium" means the paid auto-renewing subscription plan.

Article 3 (Registration and Age Requirement)

1. You may use the Service by registering an account through the method we designate.
2. The App is intended for users aged 18 years or older. Persons under 18 may not use the App.
3. You shall provide accurate registration information and update it promptly if it changes.

Article 4 (Contents of the Service)

1. The Service provides AI-assisted Japanese conversation practice, tests, learning-progress management and related features.
2. The Service consists of a free tier and a Premium tier.
3. The free tier is subject to limits including a daily usage cap and the display of advertisements.

Article 5 (Subscription)

1. What Premium includes

Subscribing to "Voikerchat Premium" gives you access to:

• A substantially increased daily conversation limit
• Access to all scenes, including anime-style scenes
• Removal of advertisements
• The learning-statistics dashboard, badge display, premium voice (TTS) and other features

2. Price and subscription period

• Price: USD 12.99 per month (tax included) for Japan and other regions.
• Prices vary by country and storefront. In certain regions, including the Philippines, we set prices in local currency. The amount actually charged to you is the amount shown on the purchase confirmation screen and in the relevant app store, which prevails over any figure stated here.
• Period: one (1) month, automatically renewing.

3. Billing

Payment is charged to your Apple ID (App Store) or Google account (Google Play) upon confirmation of purchase.

4. Automatic renewal

Your subscription renews automatically unless auto-renewal is turned off at least 24 hours before the end of the current period. The renewal fee is charged to the account above within 24 hours prior to the end of the current period.

5. How to cancel or manage your subscription

• iOS: Settings → Apple ID → Subscriptions
• Android: Google Play → Payments & subscriptions → Subscriptions

6. Important notes

• Deleting (uninstalling) the App does not cancel auto-renewal. Please cancel using the steps above.
• We do not provide pro-rated refunds for cancellation mid-period, nor refunds for the current billing period.
• After cancellation, Premium features remain available until the end of the period already paid for.

7. Refunds

Refunds after purchase are handled in accordance with the terms and procedures of the App Store or Google Play, as applicable.

Article 6 (Prohibited Conduct)

When using the Service, you shall not:

• violate any law or public order and morals;
• infringe the rights of us or any third party;
• interfere with the operation of the Service;
• gain unauthorized access, reverse-engineer, or otherwise improperly interfere with our systems;
• improperly create multiple accounts or act with the purpose of circumventing usage limits;
• intentionally prompt the AI to generate illegal or harmful content; or
• engage in any other conduct we deem inappropriate.

Article 7 (Intellectual Property)

1. Copyright, trademark and other intellectual property rights relating to the App and the Service belong to us or to the respective rights holders.
2. You may not reproduce, republish, modify or distribute content of the App without our prior permission.

Article 8 (Changes, Suspension and Termination of the Service)

1. We may change the contents of the Service, or suspend or terminate its provision, without prior notice to you.
2. We are not liable for damages arising to you as a result, except to the extent set out in Article 10.

Article 9 (Withdrawal and Suspension of Use)

1. You may withdraw from the Service at any time by the method we designate.
2. If you breach these Terms, we may suspend or delete your account without prior notice.

Article 10 (Disclaimer and Limitation of Liability)

1. We do not warrant that the Service is fit for any particular purpose, that any learning outcome will be achieved, or that AI responses are accurate.
2. The Service is intended solely as a learning aid, and AI responses may contain errors.
3. We are not liable for damages arising to you in connection with the Service, except in cases of our willful misconduct or gross negligence.

Article 11 (Changes to These Terms)

We may change these Terms where we deem it necessary. If we make a material change, we will notify you within the App or by other appropriate means.

Article 12 (Governing Law and Jurisdiction)

1. These Terms shall be interpreted and applied in accordance with the laws of Japan.
2. Any dispute arising in connection with the Service shall be submitted to the court having jurisdiction over our location as the exclusive court of first instance.
